Agreement Between User and TheRightMargin

TheRightMargin is committed to the protection of your privacy. This Privacy Policy (the “Policy”) is intended to give you confidence as you use the (the "Site"), as well as any additional services provided by TheRightMargin in furtherance of the services provided by TheRightMargin, which may include mobile and/or desktop applications and other platforms provided by TheRightMargin, as well as any associated services that are rolled out from time to time by TheRightMargin (collectively, the “Services”). The Services are offered to users of the Services (referred to herein as “you”, “your”, or “user”) conditioned on your acceptance without modification of TheRightMargin’s Terms of Use(the “Terms”), of which this Policy is a part. Any reference to “TheRightMargin”, “we”, “our”, and “us” in this Policy refers to Shivzb, Inc. DBA TheRightMargin and its affiliates, which operate the Services. This Policy covers how we collect, use, store, and share your information when you use our Services.

  2. Personally Identifiable Information. ​When you agree to our Terms and use our Services, you grant us permission to collect the following personally identifiable information about you:
    1. Information you voluntarily provide us through the Services when you create an account.

      When you sign up for an account through the Services, you will be required to provide us with your email address. You will also be able to create a pen name, which you can choose to be your name or an anonymous pseudonym. In the event that we launch a mobile application, we may require your phone number to be provided at the time of sign up as well.
    2. Information you may give us access to as you use the Services.

      As you use the Services, you may be able to upload media and other information through the Services, such as photos, documents, or other information which may be considered, or may contain, personally identifiable information. Additionally, the content that you choose to include in the Services may be considered personally identifiable information. Finally, our blog and other public forums on the Services may include the opportunity for you to provide input and you may choose to include personally identifiable information in such forums. The information described in this paragraph is provided by you at your sole discretion, but is not required to provide you with access to, and use of, the Services.
    3. Information you may give us access to outside of the Services.

      From time to time, you may provide us additional information outside of the Services, such as through email communications with us. This information may include, for example, your name and physical address, as well as others. This information is provided by you at your sole discretion and is not required for access to, or use of, the Services.

We will use the personal information we collect about you through the Services to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. Any use of your information beyond those uses will only be done with your consent.

Other Anonymous Data. ​When you create an account, you will be able to provide us with a pen name, which you can choose to be your name or an anonymous pseudonym, as well as a password. This information is generally anonymous, unless you choose to provide information that would be considered personally identifiable information. The pen name is optional, but the password is required to provide you with access to the Services. Additionally, when you use and visit our Services, we may also use third-party services, such as Google Analytics, which use first-party cookies to collect generic, anonymous information that does not identify you. We use this information to improve your user experience while using the Services. To opt out of Google Analytics cookies, please visit

Do Not Track Signals. ​We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of our Services. Third Party services that we use to expand the functionality of the Services, including Mixpanel and others, may conduct online tracking of you when you use the Services. To the extent they do so, their privacy policies dictate their practices with respect to Do-Not-Track signals, or other similar signals.

Willing Disclosure, Not Cookies. ​Although some third parties that are integrated with the Services may use cookies or other automated tracking tools, we do not directly use cookies or any automated tools to collect information about you. The information that we collect, as described above, is collected through willing disclosure by you.
  1. Information We Share

    Third Party Payments. When you make a payment via our Services, we do not collect the financial information you provide. Rather, the information is sent to a third party payment platform. We cannot, and do not, assume responsibility for the privacy practices of any third party payment platforms. The only information we share with third party payment platforms about you is the information that is necessary to process your payments. Other Third Parties Associated with the Services. ​We may disclose your personal information, on a limited basis, to third-party affiliates for the purpose of expanding the functionality of the Services. Sale of Company or Assets. ​In the event that we sell all or portions of our company or its assets, including the user information collected through our Services, we will notify you before transferring your information to the acquiring company.

    Other than as described above, we do not share your information with any third parties without your consent, unless we have a good-faith belief that such action is necessary to (1) comply with the law (see “GOVERNMENT REQUESTS” section below), (2) protect and defend our rights or property, or (3) prevent an emergency involving danger of death or serious physical injury to any person.

  2. Storage, Retention, & Security

    We use Heroku and/or Amazon Web Services to store the information you provide us through the Services. Other information that you provide us outside of the Services, such as through email communications or otherwise, may be stored through platforms outside of the Services. We also use administrative safeguards to protect your information, such as: limiting internal access to personal information based on a need-to-know basis and requiring all employees to sign confidentiality agreements that extend to your personal information.

    These measures are intended to prevent the loss, misuse, and alteration of the information that we obtain from you. Such loss, misuse, and alteration may occur despite our best efforts to protect your information. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration.

    We retain your information for a period lasting (1) as long as you maintain a user account with us (and will delete your information within a reasonable amount of time following the date when you close your user account), (2) until you request that we delete some specific information (in which case, we will delete your information within a reasonable amount of time following the date of your request), or (3) as long as necessary to comply with the law.


  3. Government Requests

    We may receive requests from government agencies to obtain information about our users. We may comply with such government requests, or we may choose to require a search warrant before we turn over information about you. To the extent permitted by law, we will notify you when we receive government requests about your data.

  4. Third Party Services Beyond Our Control

    As described above, payment processing is completed through third party platforms, and we store your information on Heroku and/or Amazon Web Services. Those third party services are beyond our control. Although we make efforts to select vendors that will respect and protect your privacy, we have no control over any third parties. Thus, we make no guarantees about, and assume no responsibility for, the information or services provided by third parties. We encourage you to visit any third parties to familiarize yourself with their privacy practices.

  5. Changes to this Policy

    TheRightMargin reserves the right, in its sole discretion, to change this terms of this Policy, with or without notice to you. The most current version of this Policy that is posted on the Services will supersede all previous versions. We encourage you to periodically review the latest Policy to stay informed of updates.
